August Color Challenge Official Rules:

PRIZES

One Grand Prize winner will receive $100 (retail value) in EKSuccess Brands products

ELIGIBILITY

Contest is open only to legal residents of the 50 United States, Washington, D.C. or Canada (excluding Quebec), eighteen (18) years of age or older before August 1, 2010. Void where prohibited by law.

The following individuals are not eligible to enter and their entries will not be considered:

Employees of EKSuccess Brands or any of their respective parents, subsidiaries and affiliated companies, or any promotion, advertising, judging or public relations company doing business with any of the above, or any of their respective parents, subsidiaries and affiliated companies, or a member of the immediate family (parent, children, siblings, spouse, regardless of where they live) or any individual living in the same household of such employees (whether related or not).

ENTERING THE CONTEST

From August 1, 2010 at 12:01 a.m. Eastern Time through August 31, 2010 at 11:59 p.m. Eastern Time, go to www.spottedcanary.com (the “Website”) to enter. Log in as a Spotted Canary member and upload an original project to the Gallery. The time of entry will be determined by the time that it is received by EKSuccess Brands.

You may enter only once, duplicate entries will not be considered. All entries must be in English. All entries must be original and developed by contestant. Use of automated processes and devices to submit electronic entries are not permitted. EK is not responsible for any changes or effects caused by or to the entrant’s computer system as a result of submitting electronic entries.

Only entries submitted via the electronic project upload form provided on the Website and subsequently hyperlinked in a comment to the corresponding challenge forum thread will be accepted. For your entry to be eligible, you must provide all information required on the registration form on the Website. Incomplete entries will be disqualified. Entries submitted via any other method, including but not limited to U.S. Postal Service, hand delivery, facsimile or other express delivery services, will NOT be accepted. EK is not responsible for entries that cannot be processed due to phone, network, electronic or computer hardware or software failure, or technical failures of any kind.

EK reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the contest or website; violates these Official Rules; or acts in an unsportsmanlike or disruptive manner at any time during the Contest, or with the intent to annoy, abuse, threaten or harass any other person. By submitting your entry, you accept all Contest rules, including those not listed here that may be added at EK’s sole discretion. You agree to be bound by the decisions of the judges, which will be final. Entries will be deemed to have been submitted by the email account holder if there is any dispute.

WINNER SELECTION

All entries must meet the requirements of the contest. Entries not meeting contest entry criteria will be disqualified. One winner will be selected by random drawing. The winner will be contacted by email on or about September 6, 2010.

LIMITATION OF LIABILITY AND RELEASE

EK and its subsidiaries, affiliates, distributors, dealers, and vendors, and these companies’ officers, directors, agents, and employees are not responsible for and shall not be liable for: (i) entries that are lost, misdirected, unintelligible, corrupted, incomplete, late, otherwise not in compliance with these rules; (ii) any act, failure to act, delay, or error relating to the transmitting or processing of entries; (iii) telecommunications network, phone system, computer system, hardware, or software malfunctions, failure, disconnection, data loss, or other difficulties of any kind, including any injury or damage to an entrant’s or other person’s computer related to or resulting from participating in the Contest, or accessing or downloading materials relating to the Contest; (iv) any conditions caused by events beyond the control of EK that may cause the Contest to be disrupted or corrupted; (v) any losses or damages of any kind resulting directly or indirectly from acceptance, use, or misuse of any prize awarded in the Contest; or (vi) any printing or typographical errors in any materials relating to the Contest. EK reserves the right, in its sole discretion, to cancel, modify, terminate, or suspend this Contest if causes beyond EK’s control corrupt the administration, security, or operation of the Contest. By participating in this Contest, all entrants agree to release and hold harmless EK, its subsidiaries, affiliates, distributors, dealers, and vendors, and the officers, directors, agents, and employees of all such companies from any and all losses, damages, rights, claims, and actions of any kind resulting from participation in this Contest, or acceptance, possession, or use/misuse of any prize, including without limitation, personal injuries, death, property damages, defamation, infringement of intellectual property rights, and claims based on the rights of publicity and privacy. An Affidavit of Eligibility/Release of Liability, IRS form, W-9, W-8BEN or W-8ECI must be completed by the potential Winner as appropriate as well as a publicity release if legally permissible, within 10 days of notification. Disqualification and selection of an alternate Winner may result if there is noncompliance within the above time period or if the prize notification is undeliverable. EK reserves the right to substitute comparable products at its discretion. EK reserves the right to cancel this promotion at its sole discretion. All entries and winners information will be loaded onto www.spottedcanary.com at Sponsor’s discretion.

PUBLICITY

By participating in this Contest, the Grand Prize winner gives permission to EK to use his or her name, photograph, voice, biographical information and likeness, and all derivatives thereof, in any and all media, for advertising and promotional purposes, without further compensation or notice, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including without limitation on-line, unless prohibited by law.
